Purpose

Kaiser Permanente Voice provides this Web site to allow interested Kaiser Permanente current employees and retirees to remain informed and educated about policy and issues affecting Kaiser Permanente. The Web site is referred to in these Terms and Conditions as the “Site.”

Agreement

BY USING THE SITE, YOU SIGNIFY YOUR AGREEMENT TO THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT USE THE SITE.

User participation in interactive services

Kaiser Permanente Voice provides you with a number of interactive online services to help you educate and be more involved in Kaiser Permanente Voice public policies. These services may include (but are not limited to): secure mobile messaging. You agree that you will not upload or transmit any communications or content of any type (including secure messaging) that infringe upon, misappropriate or violate any rights of any party.

Mobile Messaging terms

As part of the services provided by Kaiser Permanente Voice on this Site, users have the opportunity to participate in a secure mobile messaging program (the “Mobile Messaging Program”) subject to the Mobile Messaging terms set forth in this section. The Mobile Messaging Program and our collection and use of your personal information is also subject to the other sections of these Terms and Conditions, as well as our Privacy Statement. By enrolling, signing up, or otherwise agreeing to participate in the Mobile Messaging Program, you accept and agree to these Mobile Messaging terms.

  • Mobile Messaging Program Description: We may send informational mobile messages with requests for action in various formats through the Mobile Messaging Program. Mobile messages may be sent using an automated technology, including an auto-dialer, automated system, or automatic telephone dialing system. Message frequency will vary but will not exceed 6 messages per month. You agree that we, our affiliates, and any third-party service providers may send you messages regarding the foregoing topics or any topic and that such messages and/or calls may be made or placed using different telephone numbers or short codes. We do not charge for mobile messages sent through the Mobile Messaging Program but you are responsible for any message and data rates imposed by your mobile provider, as message and data rates may apply for SMS and MMS alerts.
  • User Opt-In: By providing your mobile phone number to us, you are voluntarily opting in to the Mobile Messaging Program and you agree to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal “Do Not Call” list. You agree that any mobile phone number you provide to us is a valid mobile phone number of which you are the owner or authorized user. Your participation in the Mobile Messaging Program is completely voluntary.
  • User Opt-Out and Support: You may opt-out of the Mobile Messaging Program at any time. If you wish to opt-out of the Mobile Messaging Program and stop receiving mobile messages from us, or you no longer agree to these Mobile Messaging terms, reply STOP, QUIT, CANCEL, OPT-OUT, and/or UNSUBSCRIBE to any mobile message from us. You understand and agree that the foregoing is the only reasonable method of opting out. For support, reply HELP to any mobile message from us.
  • Our mobile messaging platform may not recognize requests that modify the foregoing commands, and you agree that we and our service providers will not be liable for failing to honor requests that do not comply with the requirements in these Mobile Messaging terms. We may also change the telephone number or short code we use to operate the Mobile Messaging Program and we will notify you of any such change. You acknowledge that any requests sent to a telephone number or short code that has been changed may not be received by us and we will not be responsible for failing to honor a request sent to a telephone number or short code that has been changed.
  • Disclaimer of Warranty and Liability: The Mobile Messaging Program is offered on an “as-is” basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Mobile Messaging Program.
  • Modifications: We may modify or cancel the Mobile Messaging Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Mobile Messaging terms at any time. Any such modification will take effect when it is posted to the Site. You agree to review these Mobile Messaging terms periodically to ensure that you are aware of any modifications. Your continued participation in the Mobile Messaging Program will constitute your acceptance of those modifications.
  • You acknowledge that you are aware text messages are not fully secure and could be intercepted by a third party and acknowledge if you share your mobile device with others, they may be able to view text messages sent by Kaiser Permanente Voice. It is your responsibility to understand the risks of receiving text messages on your mobile device. To update your mobile phone number, Visit https://kpvoice.kaiserpermanente.org/a/preferences and enter your registered email address to receive a unique login link. Once you arrive at your Preferences page, you may choose the pencil icon next to the Phones heading to edit your phone number and your mobile messaging opt-in status, then Save your preferences.

Any personal information you submit to the Site is governed by the Kaiser Permanente Voice privacy practices. This includes information on your right to see and receive copies of your personal information. To deactivate your Kaiser Permanente Voice account, please contact info@voice.kp.org. To the extent there is an inconsistency between these Terms and Conditions and the Kaiser Permanente Voice privacy practices, these Terms and Conditions shall govern.

In consideration of being allowed to use Kaiser Permanente Voice interactive services, you agree that the following actions shall constitute a material breach of these Terms and Conditions:

  • signing on as or pretending to be another person
  • using secure messaging for any purpose in violation of local, state, national, international laws or posted Kaiser Permanente or Kaiser Permanente Voice policies
  • uploading or transmitting any communications, content, or material of any type (including secure messaging) that infringes upon, misappropriates or violates the intellectual property rights of others or the privacy or publicity rights of others
  • transmitting material that is unlawful, obscene, defamatory, predatory of minors, threatening, harassing, abusive, slanderous, or hateful to any person (including Kaiser Permanente and Kaiser Permanente Voice personnel) or entity as determined by Kaiser Permanente Voice in its sole discretion
  • using interactive services in a way that is intended to harm, or a reasonable person would understand would likely result in harm, to the user or others
  • collecting information about others, including e-mail addresses
  • intentionally distributing viruses or other harmful computer code
  • attempting to (1) probe, scan, “hack”, or test the vulnerability of the Site or any Kaiser Permanente Voice system or network; or (2) breach any security or authentication measures on the Site or any Kaiser Permanente Voice system connected to the Site
  • using any “deep-link”, “page-scrape”, “robot”, “spider”, data mining tools, data gathering and extraction tools, or other automatic device, program, algorithm or methodology, to (1) access, acquire, copy or monitor any portion of the Site, or (2) in any way reproduce or circumvent the navigational structure or presentation of the Site

Kaiser Permanente Voice expressly reserves the right, in its sole discretion, to terminate a user’s access to any interactive services and/or to any or all other areas of the Site due to any act that would constitute a violation of these Terms and Conditions.

Use by Children

We do not knowingly collect personally identifiable information from children under the age of 13. If Kaiser Permanente Voice is made aware of collecting information from a child under 13 we will delete this information.

Access, correction, and data integrity

Although we attempt to maintain the integrity and accuracy of the information on the Site, we make no guarantees as to its correctness, completeness, or accuracy. The Site may contain typographical errors, inaccuracies, or other errors or omissions. Also, unauthorized additions, deletions, or alterations could be made to the Site by third parties without our knowledge. If you believe that information found on the Site is inaccurate or unauthorized, please inform us by contacting our Web manager.

Revisions, changes, and updates

We may revise the information on this Site or otherwise change or update the Site, including these Terms and Conditions, without notice to you. Kaiser Permanente Voice may also make improvements and/or changes in products and/or services described on this Site or add new features at any time without notice. We encourage you to periodically read these Terms and Conditions to see if there have been any changes to our policies that may affect you. Your continued use of the Site will signify your continued agreement to these Terms and Conditions as they may be revised.

Links to Third Party Web sites

This Kaiser Permanente Voice Site provides links to other web sites that are not owned or controlled by Kaiser Permanente Voice (“Third Party Web sites”). Kaiser Permanente Voice provides links to Third Party Web sites to connect you easily to additional sources of issue or policy information that may be of interest to you. We may not have any business relationship with the party that controls this type of Third Party Web site and a link to such a site is offered only as a convenience to you.

Kaiser Permanente Voice also provides links to Third Party Web sites managed by vendors that we have made arrangements with to offer you services to help inform and educate. These Third Party Web sites may be co-branded, meaning that they display the Kaiser Permanente logo and the logo of the Third Party vendor but they are owned and controlled by the Third Party.

In each such instance, we will let you know when you are leaving Voice.KaiserPermanente.org and linking to a Third Party Web site. For example, we may include a notice advising you that you are being sent to a Third Party Web site on our web page adjacent to a link or on the first page that appears after clicking on a link. Or we may use an icon that we identify with an appropriate legend to let you know when you are leaving Voice.KaiserPermanente.org.

Kaiser Permanente Voice may not be responsible for the content, security or the privacy practices of Third Party Web sites. Please review the Privacy Statement and any terms of use of each Third Party Web site you visit, if applicable. Unless we specifically advise you otherwise, links to Third Party Web sites do not constitute or imply endorsement by Kaiser Permanente Voice of those sites, the information they contain or any products or services they describe. Kaiser Permanente Voice does not receive payment or other remuneration in exchange for your linking to or using any Third Party Web sites.

Passwords

Kaiser Permanente Voice has several tools that allow you to record and store information. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your Kaiser Permanente Voice online password or account. It is your sole responsibility to (1) control the disclosure and use of your activation codes and password; (2) authorize, monitor, and control access to and use of your Kaiser Permanente Voice online account and password; and (3) promptly inform info@voice.kp.org of any need to deactivate a password.
